Pre-Payment Terms and Conditions for Paid Subscription
To be accepted by the subscriber before making payment
By proceeding with payment, subscription, renewal, upgrade, or activation of any paid feature on WizardCA, the subscriber confirms that he or she has read, understood, and agreed to the following Terms and Conditions.
1. Nature and Purpose of the Platform
WizardCA is an educational, revision, and practice-support platform intended solely for learning, self-assessment, concept building, mock practice, and examination-oriented preparation. The content, questions, explanations, notes, tests, prompts, and other materials made available through the platform are provided only for educational, guidance, and practice purposes.
2. No Use in Live Professional Environment
WizardCA is not intended to be used as a substitute for professional judgment, statutory interpretation, official notifications, original study material, or expert advice in any real-life professional, legal, tax, audit, compliance, consulting, certification, or other live environment. Any application of the platform content in an actual engagement, assignment, filing, representation, advisory matter, or business decision shall be entirely at the user's own discretion, responsibility, and risk.
3. Content Preparation, Accuracy, and Updates
WizardCA has exercised substantial care, caution, and diligence in the preparation, review, and presentation of the content made available on the platform, including through a combination of technology-assisted processes, AI-supported checks, and manual review mechanisms, with the objective of minimizing errors and improving reliability. However, notwithstanding such efforts, the possibility of inadvertent errors, omissions, interpretational differences, technical inaccuracies, formatting issues, software-related issues, or content variations cannot be entirely ruled out. Accordingly, WizardCA does not represent or warrant that all content will, at all times, be wholly complete, current, error-free, uninterrupted, or universally suitable for every user, examination, attempt, or factual situation. The subscriber acknowledges that laws, standards, rules, regulations, notifications, professional guidance, and examination patterns may change from time to time, and therefore important matters should be independently verified from official publications, original sources, and other authoritative material before reliance is placed upon them.
4. No Guarantee of Examination Success
WizardCA provides educational assistance and practice support only. The platform, its owners, developers, management, contributors, trainers, associates, affiliates, licensors, and service providers do not make any representation, assurance, or guarantee that use of the platform will ensure passing of any examination, attainment of any rank, score, exemption, interview success, or any particular academic or professional outcome.
5. Limitation of Liability
To the maximum extent permitted by applicable law, WizardCA and its owners, developers, management, employees, consultants, trainers, content creators, associates, affiliates, technical partners, licensors, and service providers shall not be liable for any direct, indirect, incidental, special, exemplary, punitive, or consequential loss or damage arising out of or in connection with the use of, inability to use, interruption of, delay in access to, or reliance upon the platform or any content made available through it.
6. Consequential Loss Disclaimer
Without prejudice to the generality of the above, WizardCA and its associates shall specifically not be responsible for any consequential or indirect loss, including but not limited to loss of academic opportunity, loss of preparation time, loss of expected results, loss of income, loss of professional opportunity, loss of data, loss of reputation, or any similar downstream impact arising from use of the platform or reliance on its content, features, explanations, tests, prompts, or study tools.
7. Subscription Fees and Payment
All subscription fees, access fees, renewal fees, upgrade fees, promotional fees, and other charges payable for use of WizardCA are payable in advance unless expressly stated otherwise. Access to paid features shall commence only upon successful receipt and confirmation of payment.
8. No Refund and No Adjustment Policy
Once any amount is paid towards subscription, access, renewal, upgrade, feature unlock, test series, notes, course content, or any other paid component of WizardCA, such payment shall be final and non-refundable. No amount once paid shall be refunded under any circumstances and no such amount shall be adjusted, transferred, substituted, or set off against any other user, course, paper, plan, product, service, or future subscription, except where WizardCA, in its sole discretion, decides otherwise in writing.
9. Access Period and Validity
Paid access shall remain valid only for the subscription tenure or access period specifically displayed or communicated at the time of purchase. Upon expiry of such tenure, access may cease automatically unless renewed in accordance with the then applicable terms.
10. Extension or Enhancement of Access Tenure
Any extension of validity, enhancement of access period, goodwill continuation, grace period, promotional extension, restoration of expired access, or any other additional benefit relating to subscription tenure shall be purely at the sole and absolute discretion of WizardCA management. The subscriber shall have no right, claim, or entitlement to demand any such extension. Any extension granted in one case shall not constitute a precedent for any other case.
11. User Account and Access Security
Access to WizardCA is personal to the subscriber and shall not be shared with any other person. The subscriber shall not share login credentials, OTPs, subscription access, downloadable content, screenshots, or account usage with any third party unless expressly permitted by WizardCA. The subscriber shall remain responsible for maintaining confidentiality of account credentials and for all activities carried out through the account.
12. Prohibited Conduct
The subscriber shall not copy, reproduce, distribute, publish, record, transmit, scrape, download in bulk, reverse engineer, resell, commercially exploit, modify, or create derivative material from the platform content, software, design, analytics, or any other component of WizardCA. Any unauthorized sharing, misuse, extraction, or interference with the platform may result in suspension or termination of access without refund and may also invite further legal action, wherever applicable.
13. Intellectual Property
All content, branding, logos, app design, software, question banks, notes, explanations, study tools, analytics, features, structure, layout, and presentation style available on WizardCA are the intellectual property of WizardCA and/or its licensors, unless otherwise stated. The subscriber is granted only a limited, non-exclusive, non-transferable, revocable right to use the platform for personal educational purposes during the subscribed period.
14. Modification, Suspension, or Discontinuation
WizardCA reserves the right to modify, update, replace, suspend, withdraw, discontinue, or restrict any feature, content, module, plan, tenure, pricing, question bank, explanation bank, or service component at any time, with or without prior notice, subject to applicable law.
15. Technical Issues
WizardCA does not guarantee uninterrupted or error-free access at all times. Temporary inaccessibility may arise due to maintenance, server issues, internet connectivity problems, device limitations, software bugs, third-party service interruption, force majeure events, or other technical causes. Such temporary issues shall not, by themselves, entitle the subscriber to any refund, adjustment, compensation, or extension as a matter of right.
16. User Responsibility
The subscriber is solely responsible for ensuring suitability of device, browser, app version, internet connectivity, and overall technical environment for proper use of the platform. The subscriber is also responsible for consulting and relying upon official and updated sources for final examination preparation, legal interpretation, professional reference, and real-world application.
17. Suspension or Termination of Access
WizardCA may suspend, restrict, or terminate access, without refund, if it reasonably believes that the subscriber has violated these Terms and Conditions, misused the platform, shared access, infringed intellectual property rights, attempted unauthorized extraction of content, or engaged in conduct prejudicial to WizardCA or its users.
18. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any dispute, claim, difference, or proceeding arising out of or in connection with WizardCA, its subscriptions, content, usage, or these Terms and Conditions shall be subject to the exclusive jurisdiction of the competent courts at Hyderabad.
19. Acceptance of Terms
By clicking the payment button or otherwise making payment for any paid feature of WizardCA, the subscriber expressly acknowledges and agrees that the platform is meant only for educational and practice purposes, does not guarantee examination success, fees once paid are non-refundable and non-adjustable, any extension of access is solely at the discretion of WizardCA management, and all disputes are subject to Hyderabad jurisdiction.
